Legally the police can keep your computer as long as their case is open. Now you can file an injunction at your local courthouse to have the computer returned if there really is no evidence on it. More than likely they are going to keep it until the case is closed. Your best bet is the injunction but it can cost a lot of money. You're looking at having to pay court costs, fees to file the paperwork and possibly even lawyers fees.

Confiscating desktops is an pointless formality in at present's technological age. All it particularly is needed is to acquire permission to function a application that promptly feeds the concepts to regulation enforcement. edit: shouldn't take extra advantageous than 24 hours, except they verify to maintain it for data.

If it is a business computer and you can prove it.....then the hard drive should be imaged on scene to prevent the business from losing out on anything. If it is a personal computer then there is really no limit. Just as long as the drive takes to image and conduct a forensic exam.

It depends on how long the judge who has signed off on your search warrant has granted them to seize your property. Unfortunately, it's not really something you can find out. Call an attorney, however who can speak to the police counsel's office. They will probably blow him off, though.
