What is a trespass warning in the U.S., as given by law enforcement? Is this a written document or an oral warning? What is its effect? Can the person warned be arrested immediately upon being seen upon the property again? How long can such a warning remain in effect? Can it be issued on public property or only private property?
Please provide any law enforcement/legal sources.
Many thanks.

In Florida a trespass warning is given to you by the property owner or his designee, which is most often a law enforcement officer, and can be oral or written, but is most often in written form for use in court if necessary. From the point that you're given the warning you can NEVER go back onto the property until the owner invites you back. If you go back onto the property you will be arrested for trespass after warning. I have made many of these arrests and have never lost one.

In my own state a complaint of trespass is received and law enforcement responds finding the trespasser still on the property. Law enforcement will have the owner give a statement simply saying "You are hereby trespassed from my property...do not return."

Should the trespassed party return, law enforcement will arrest the suspect for the offense.

If an individual is creating such a problem on PUBLIC property that suspect can be arrested for disturbing the peace or disorderly conduct!

Best wishes.

in Mo if you have property and a sign that says No trespassing then you can be arrested, prosecuted and fined for entering such land
My brother had a sign saying
No trespassing
those not prosecuted will be shot,
after all if it is your land you should have a say who enters on it and when

i got two of these tickets in Florida...and the judge threw them out.sometimes the cops like to mess with you and give you one even though they know its b.s. anyhow if someone points a shotgun at you.it pretty much means your tress passing on there property.the next warning you may not like.so go on and git.but if there is no signs then your not breaking the law.its clearly states that the signs must be posted before you are trespassing..hoped this helped.
