I was engaged. I ended the relationship. Now he wants the ring back. He turned out to be the biggest jerk ever, very abusive. Do I have to return the ring?

Although etiquette rules that an engagement ring should be returned when a wedding is called off regardless of who broke the engagement, the legal system has differing opinions on this issue.
Some of the circumstances that determine if an engagement ring has to be returned include where you live, how you received the engagement ring, and who broke the engagement.

Conditional Gift States
Many courts look at an engagement ring as a conditional gift that is given in contemplation of marriage. If there is no marriage, then the engagement ring needs to be returned.

The courts also have held in these states that the reasoning for no-fault divorces holds for no-fault broken engagements so an engagement ring should always be returned regardless of who decided to call off the engagement.


Implied Conditional States
In these locales, if the guy breaks the engagement, he won't get the ring back. If he doesn't break the engagement, he can request its return.

California

Unconditional Gift States
Other courts have held the belief that an engagement ring is an unconditional gift and so it doesn't need to be given back.

Family Heirloom Engagement Rings
If you are considering giving a family heirloom engagement ring, legal experts recommend having a prenuptial agreement that lists who will keep the engagement ring in the event of a break up.

If you broke off the engagement the proper thing to do is return the ring. Why do you want the ring anyway as it has bad memories?

Be the better person and return it and move on. If you are holding the ring for spite it will only hurt you in the end, make a clean break.

Yes. If the relationship ends without going through with the marriage, then the ring goes back to the giver. The ring is given as a symbol of commitment to marry.

If you ended it then you need to return it. It could be a legal issue in which you shall lose as a ring is given as a promise of marriage and you were the one who ended it.
Keep in mind that it is not a give and it is given as a condition of marriage.

Keep it. It was a gift so it's your property. Sounds like you deserve it anyway. There's no legal contract involved. It's not like he said "I'm giving you this ring and in return you have to marry me, so now we're in a binding contract." That's ridiculous. Any judge would view it as a gift, which is your property.

Yes, give the jerk his ring back! Why would you wanna hold onto it anyway??? You can buy your own jewelery Im sure!

if u ended it u have to give it back. if he ended it then u get to keep....thats how its always been (doesnt matter if he was abusive or not. even tho thats unfortunate u more than likely knew about this attribute before u got engaged)

Legally you are bound to give it back to the jerk. Color yourself lucky to get away before it was too late.

No !!!!!!!!!! You do not have to give the ring back . That is your choice if you want to do that . I seen a show onetime on that , and it answered no. Hope that answers your question !!!!!!!!
