One of my friends was dating this guy for a couple months and the had sex a few times. But the last time, she didn't want to. She told him no several times, but in the end she just gave in. She didn't say yes or anything. She just stopped fighting. Was it rape?

i think that technically this is considered rape. If she showed signs in not wanting to have sex and in any way he forced her to do it, that is rape. In this situation though it is hard to tell becasue they are dating, but clearly if she didnt want it, it was wrong for the guy to pursue her at that time. Honestly if my girl doesnt want sex, the sex is not as good.....so. never force a girl to do that.

Yes that would be considered rape anytime a man or woman forces another to have sex when it is not consensual or even when they are in a relationship soon as the person says no it is to stop if the action is not stopped it constitutes as rape. Most women think because they may be in a relationship it is not rape
that thinking is wrong even people in dating and marriage can be raped and the other person charged with the offence. I do not know how long ago this occured and if your friend got bruises
in the end most rape cases if there is a lack of evidence it is a he said she said battle. If she does not want to charge this guy atleasttalk to her about getting some crisis and grief counselling.

Legally - yes.
If she did not give consent then any penetration is legally rape. In reality nothing much will ever come of it even if she charged him. Not unless there is more to this story than you are telling. Almost no jury would convict in this case as it is too ambiguous. If she did not tell him no or resist him then his attorney will argue that there was "implied consent" based upon their history.

A defense attorney would call this "buyers remorse" and attack her on the stand. If your friend called the police they would come out and take a statement from her. She would then be asked to see a Sex Assault Nurse Examiner. From what you wrote there was no violence so the SANE nurse would only determine that there had been intercourse.

The police would then take a statement from the suspect who would no doubt call it consensual. The city attorney would then have to decide whether or not to go to trial based upon the evidence. Fact is, the attorney's office is judged upon its' conviction rate and not the number of cases it takes. No one would want to take on this case. Of course, juries are notoriously fickle....... If they did charge him he might just plead it down to some kind of assault charge. He would want to plead it to an assault charge so he wouldn't end up a registered sex offender.

Remember too that every state is different. There may be other things that apply to this case based upon where it occured. There may be more too if she is underaged etc.

Yes it was a rape.

Did not have consent of your friend, and forced his way. Rape.

How is she feeling? Is she really disturbed by the incident? Was she hurt or humiliated? Somehow she has to make a choice about the matter. If shes freaked, then she needs to talk to someone.

Yes, it consider Rape. if another person is unwilling, it consider Rape and it can be report to the police or can be sued, but this matter can be tricky case.

Because Defence Lawyer can ask why the other party give in.
(Lawyer loved this method for this case, always)

How long had this happened? (the time interval between the rape to the matter reported)

Was there threatening? this can help the innocent party.

Was there any prove (evidences or witness) that this happened?

What will the compensation be? (for suing case)

If she gave in then no its not rape. If her bf had any class he would have stopped when she said no the first time, but so many girl say "nooo... i REALLY shouldn't" and then get mad when the guy does stop. Unless she tried to get away from him it was not rape.

She said no couple of times that to me is rape, she gave in now because she don't know what to say which language he will understand.

This is hard to answer cause the same thing happened to my best friend... in a way it is because she didnt have a say in the matter, but because they have done it before its not as bad ..she was dating him and they had had sexual intercourse before, she was not a virgin, she stopped fighting!..you have to take all of this into account... in his case he is a dog and was completely wrong in every way!!! and she will probably be withdrawn from guys for a while... my answer: i would say to a certain degree yes it was but in some aspects no.

She is the only one that was there and the only one that can answer this question. Just because she gave up...and put out, that might be taken as consenting adults...if he forced himself on her and she kept saying no...then yes...

Why is she still with him???

Technically yes, That guy has NO RIGHT under any condition to force hisself upon her or anybody. If she refused and he gave her no choice than yes its is rape, perhaps she should contact someone for help so it doesnt happen again. it could also cause psychological harm to her. What if she totally resisted??? he would have hurt her even killed her, it happend before and it will happen again... get help, its no joke
