The child is a 16 year old with a history of violence.

The child is sitting in Juvenile Detention as we speak on an assult charge against his father he also slashed one of my tires. Earlier this evening the father went to visit him and he threatened to do it again!!

The child is my fiances son. Since he and I have both been threatened by him on more than one occassion we're not exactly king on having him live with us at least not until he gets the help that he needs.

It saddens my heart to think that children would EVER rise up against their parents.
To answer your question...of course. You would need to take the child to court and ask the judge to put a restraining order on your child. You can call the county courthouse to get more information.
Secondly, maybe you should have a "Mediator" sit down with you and your child and find out why he/she is so angry. Sometimes, the lack of attention drives a child to do drastic things to get attention. Remember, you created and gave birth to that child out of love. Try to work it out with a counselor or therapist. There might be emotional scars or deep seated hurts that need to be worked out.

How is the child related to you? Is he your son? I don't know about a restraining order, but if you have legal guardianship over him you can tell the juvie judge that you can't have him living at home anymore. He'll probably be placed in a group home or foster care until he's eighteen. If none of this applies to your situation then I think you should look into your legal options. A restraining order or something to that effect sounds necessary.

In most cities, no you can not get a TRO or FRO against a minor for a minor. in my case they said that minors are not mature enough to understand and comprehend the ramifications of certain situations. (like the same reasons minors cant engage in legal binding contracts)

you have to check with your local prosecutor. when i was in high school i tried to file against someone who jumped me and they said because we were minors and attended the same school that one could not be filed...(though she looked and punched like a grown man on steriods) It resulted in me having to have a security guard escort me to and from class for about 3 weeks until her court hearing was over and she basically was put in juvenile detention.

Yes, you can file a restraining order so go fill out a report with the sheriff or police department.

does his dad agree that he needs the help or just right now he thinks that. beware. a parent will side with the child because of denial. trust me on that one!

and no you cant get a r/o on a child. the parent is responsible for controlling behavior of the child.

YES IF YOU FILL IN HARMS WAY OF THE CHILD YOU HAVE TO GO TO THE COURT HOUSE IN YOUR STATE AND FILL THE PAPER WORK WITH THE LAWYER AND JUDGE SO HE CAN NOT COME WITH IN 500 FT OF YOU IS THE LOWEST IT GOES SO SORRY TO HEAR THIS HAPPENED TO YOU OK
