If a fetus is killed in the act of a crime its murder.
if a fetus is not a living being and merely tissue that can be oborted
legally how is it in the other situation a murder punishable by prison?
think about! it do you liberals merely clasify thing based upon

Its so funny that no one thinks about the child... That child has the same right as the mother -> the Right to Live. just tell the lil girl that was born at 22 weeks that she has no rights. It is a living person. And it is MURDER and if you don't think so then your just kidding yourself. I just had my first child a month ago and i look at him and can't see how someone could want to harm him, he is so innocent.
I don't see how anyone with children can agree with abortion.

Generally, if murder charges are brought for the killing of a fetus, the pregnancy was far enough along that the developing child would likely be able to survive outside the mothers womb. Legal and medical standards apply, feelings and morals not withstanding.
But you weren't really looking for an answer, were you?

This seems simple to me. If the intent of the killer is to "kill" a human then the charge is murder. If on the other hand the intent is to abort a fetus, then there is no murder. This is really simple.
Further, if the fetus belongs to the woman and it is killed when she had full intention to give birth then it is clearly murder. If on the other hand she was in the abortion office when the fetus is killed, then maybe murder would not be the right charge. That is why we have juries.

I have no idea why it is considered murder when a fetus is killed by someone other than the mother. It should be felony vandalism or something. The only reason the laws you speak of are on the books is because nobody contests their constitutionality.

A Japanese scientist (sorry I forget his name, his work is featured in the movie "What the @#$% do we know"?) conducted an experiment on water molecules. He put water in bottles, then put labels on the bottles: love, hate, joy, disgust..etc, some he had blessed by Buddhist monks. In time the water molecules came to look quite different. The molecules in the "disgust" bottle looked like sickly, deformed, toxic lumps. The "love", "joy", and blessed molecules were strikingly beautiful, some looked like snowflakes. What do you think the effect would be on a fetus growing in the womb of some 15-year-old crack head who never wanted a child, has no idea how, and no interest in taking care of one and actively, intentionally does everything she can to hurt it because she's not allowed to have an abortion? I wonder how many of the worlds problems have been caused by people who were never wanted or loved as children.

i wouldn;t consider the fetus being killed in a crime murder either. And i think it would be wrong to charge someone with that. However, if the mother survived, she should be elidgeable for some kind of extra compensation for her loss. But its not a murder.

That is a relatively new law and has nothing to do with abortion! It has to do with people who murder women that are pregnant!

A fetus is not a child by any definition!

How is your moral standard for troops and Iraqis dying for oil? How is your moral standard for capital punishment, even those who are incompetent, like Bush did?

Hows you moral standard for the million or so children we starved to death in Iraq with out blockades!

How much have you done for children who are starving in this country and you conservatives want to cut what ever meager amount they get! I guess you would rather kill a living child!

How is your moral standard about supporting people who you want to force to have a child and are the reason in many cases as you have had birth control removed from schools! Are you going to support them, or cut them, like you are dong now?

You can apply your moral standard all you want to yourself, but until you talk to God, leave him out of it!

Aborting should be safe and legal to any woman who chooses to have one.

I find it funny that conservatives argue for as little Government intervention into the individuals life as possible, but then flip flop like a fish on the issue of a woman's right to control her own body (rather than the State interveining). You people are backwards, simply backwards...

end of story.

probably the same reason why a person might get in trouble if they stomped someone else's kidneys, but a person wouldn't get into any trouble if they ruined their own kidneys

It's always murder. Call it what you wish. It also imparts mental anguish on the mothers but nobody considers them do they?
