my husband has had me served with court papers to have his child support lowered. Im wondering if i can ask the court to dismiss this petition on the basis that my x husband lied when filling it out?

would photos of his current residence and whitepage listing and court documents of his eviction from former address be strong enough evidence?

The false info on the court papers is his address and phone number.

Yes, you can ask for that. In order to get it, though, you will need to provide some evidence.

Strong evidence would be an affidavit stating your belief, with a copy of his tax return exhibited (assuming the tax return supported your side of the story)

It probably doesn't matter much where he lives, unless he just moved into a mansion. The fact that the materials show his old address and phone number would not, alone, be grounds to dismiss his petition.

I would think the court is more interested in his income than where he lives. That said, if he lied about his address, they are likely to require more evidence that his income is not more than he claims.

No, you will have to talk to the judge now to request a dismissal on the grounds of your husband fraudulent information

Well if youc an prove it just get a hold of your lawyer and he can file a motion to dismiss it. But it just depends if you can prove it.

No, and you should be ashamed of yourself for trying. Why should he pay you money he dosn't owe you? I'm SURE you don't pay bills you don't owe. I'm glad you posted this question, it reinforces what I've been saying. Scandoulas women wanting a check.
