If you get picked up and taken to jail on a warrent, can you go to court and plead not guilty and be released, or will you be sentenced at that time. The crime is theft.

You'll sit in jail until you can go before the judge.

Then it's up to the judge. You'll most likely have to post bail, and then you're free to leave until the trial.

1. If there is bail set on the warrant, you can post that bail and be released before your next court appearance.

2. If there is no bail on the warrant, then you will have to wait until you appear before the judge.

3. You are never sentenced if you plead not guilty. If you do, the judge will fix a bail for your release pending trial, or may release you without bail if you are not a flight risk. If the warrant was based on a failure to appear, that is probably not likely.

4. You can plead guilty (though you should not do so without consulting an attorney). The judge may sentence you at that time, or may continue the matter to get a probation report. You may or may not released during that period of time.

There's grand theft and petty theft, which makes a difference. A warrant is issued because a criminal complaint has been made of there is a criminal indictment or because the person has failed to appear for a scheduled hearing.

If the warrant is not for failing to appear, the subject of the warrant is arrested or surrenders on the warrant and is then arraigned. Bail is set or not depending on the history of the defendant for not showing up for scheduled hearings, or if the court believes the person may harm somone if let out on bail. A date for a pretrial conference or a trial date may be set at that time. If bail or personal recognizance is set, you are released until the next hearing date.

You can always plead guilty (or no contest) at the arraignment and save everone time and money. You will be sentenced at that time.

If you went to court or were issued a citation for the theft and you never made your next appearance, you will most likely not be released without some kind of bail.

If a warrant was issued for you from a theft charge that was filed and you never went to court at all, then maybe. Depending on the severity of the charge.

You always have the option of pleading guilty or not guilty, a warrant is not a guilty sentence it is merely a tool to get you into court.

If you are arrested, you can go before a judge and plead not guilty.The judge can then set bail. If you pay it you're free to go until your trial date.

You could ask for a bench trial, but, you may have a better chance with going to the jury trial. Your lawyer and the prosecutor may be more willing to make a deal to avoid a trial.

If you are really innocent though, I would go to trial.

It depends on the warrant. If you failed to show up for court or you fled or you violated parole then you will sit in jail until you go to the judge.

If it's an arrest warrant you sit in jail until you see a judge then you may be released after you enter your plea.
