I e-filed my federal taxes Jan. 23, 2006 and I had to file injured spouse. My question is .... How long will it take to get them back? I have checked the irs website & all it says they that there is a delay. We are doing direct dep. I am the only one working, so it should not take that long but last year it took 11 weeks.

Because the IRS will process your allocation request before an offset occurs, filing Form 8379 with your original return may take 11 to 14 weeks from the date of filing to process your return.

You should NEVER e-file if you are filing a Form 8379! When you e-file, the offset occurs fairly quickly, often before the Form 8379 is ever processed. When that happens, it can take many months for the transaction to be rolled back. If it was for child support and it has already been paid over to the custodial parent, it will not be recaptured from them without the recipient's consent; you'll have to wait until next year for your refund allocation.

When filing Form 8379, ALWAYS file a paper return and attach the Form 8379 to the return. It should be processed in 8 - 10 weeks that way.
