i was a passenger in a car that was confiscated by the police for no insurance. the driver ran off at the seen and no 1 has seen him since, the police confiscated the car for no insurance. in the car where my belongings, i have contacted the police over this and they have refused to let me have them back. can they do this?

also just wanted to add the polices reasins where because i am not the owner of the car, but the owner of the car did a runner and is untrace able.

the belongings where my babyseat, loads of cds and a few of my towlels all of which i do not have reciepts for.

also i was not aware the driver had no insurance.

the car was driving my a friend, who failed to stop at a insurance check point!, i was unaware the driver had no insurance, and have co operated with the police and given the drivers details, but he is untracable, the items in the car are not being used for evidence.

No, they have no powers to confiscate property belonging to anyone, unless they are intending to use it as evidence against you.

You were the passenger in an uninsured car driven by one of your friends or aquaintances.

The driver ran off from the scene, one assumes you mean the scene of an accident, and you have obviously claimed not to know the driver.

I hate to call you a liar, but I suspect that you know full well who was driving, and possibly that you also knew that the car wasn't insured.

I would be very worried if I were you, aiding and abetting in the commission of a crime is a very serious offence, and with the police having your property as evidence...

Just don't count on being free to walk the streets for much longer, not that I think you'd get more than a couple of years...

Yes, if they cannot positively say you are the owner, the can rely on the driver/keeper being the owner of all contents....in fact they are responsible for the property, so giving it up to any Tom Dick or Harry just on that persons say- to do so could make them liable to discipline proceedings
Morale: - dont get in a car with a prat - if you had a baby seat in there, with a baby in it, & no insurance, what would you have done after a crash to get compensation?????

It's very unlikely I'm afraid, unless you can prove somehow they are your items. This is just for the pure fact that the Police don't know those things are yours. It would leave them open to all sorts of legal action should the items you wish to take actually belong to the owner of the car (I'm talking hypothetically), who may want them back one day and find the Police have given them to his friend.

if you stayed with the car after the driver ran off it normally takes half hour for a recovery vehicle to come and collect the car on the police behalf why didn't you take your belongings out there and then! the other alternative is your driver friend who is not contactable by police but I'm sure he/she is by you, why don't you get in contact tell them to get the car insured take the insurance cert to the compound and get the car out hence getting your belonging back and having a legit car on the road !

Jeez, hardcore folks. Unfortunately you will not be able to get your belongings back unless providing proof of ownership. The impound lots just can't hand over property to anyone who asks for it without proof. Understandably car seats are expensive, you can contact either the state division of motor vehicles or the local agencies in your area, there a bunch of programs that give car seats to folks who otherwise can't afford it. Check this website:
www.nhtsa.com or .org - I forget now - but they also have programs to get car seats to folks. Also check with area hospitals for additional programs.

As far as your Cd's and stuff, you are probably out of luck.

I think that the owner of the car screwed you. The police are just trying to do their job. The owner needs to step up and go with you so you can have your stuff. otherwise, you may as well consider everything stolen.

no they cant as it wasnt your car, but if you knew that the driver had no insurance and willingly got in the car with them then that could be different. If the car is going to be scrapped then they def cannot keep your belongings

I can picture it now, a mother, baby and boyfriend driving around. No insurance, no tax, no MOT got to be a loser for buggering off and leaving you to it! Im sorry but ignorance is not always bliss, is it?

If you go to the Police Station with proof that the belongings are yours, then they will give them back.
