Ok, I bought a xbox 360 and some games from a shop. It was second hand but this shop sells mostly second hand and ex pawn shop stuff.

Anyway i got it home and set it up and after abotu a hour it started makign a weird noise like the fan was working to hard like a whizzing noise, now I have had one of these computers before and it did not act like this.

So I took it back to shop and he said he did not have an other one so he could not offer me a swap and he was not prepared to offer me a refund cause he said it was not broke, but then offer me a credit note for the store, i did not want this, i want a working computer or my money, in the end he told me to take it away and he would not be swapping it or giving me a refund or credit note, surely he can't do this just because he says it is not broker, thats not fair.

normally when you buy a second hand console you have a period of time that you can take it back normally about 3months (i'm sure that what i got when i bought a 2nd hand xbox from game station). but you should have 28day to take any electrical item back to the store if not working under the sale of goods act unless it says sold as seen. go print off the sale of goods act its on a .gov website and take it down to the store with the xbox then if he doesn't do that take him to a small claims court it should be a dead cert you winning that. If thats no good get loads of your clumsey mates to come with you in to the store and accidently know a few things over on the way out. if he says you broke it say it was already broken just like my xbox.

It sounds like you should have asked a few questions before buying. It does not seem that you have much comeback but rather than taking the item home again I would accept a credit note and wait for something else to come into stock. But make sure you have a decent time limit on your credit note.

most second hand computers i have bought have a 3 month guarantee on them the problem with second hand shops is that if it switches on it works they don't properly test them tell him you want a full re fund or you go to trading standards and also write to local papers they are normally desperate on story's any way look it up and research your rights before you go back and go in knowing what you are talking about if you get the facts then he can have no argument with you

did you read the return policy sign before you bought the item.
At the point you are at you can only take him to small claims court, and if you loose your out what you paid for smal claims plus the amount of the item. Since i feel you will losse. I would suggest doing one of those tv shows that you get paid to do. Atleast you will walk away with something. like judge judy.
