I had hair extensions fitted by a mobile hair extensionist yesterday and the 'heat tool' that she used to melt the glue, touched my ear and has burnt it quite bad.. not only am i in some pain and discomfortable due to the burn, but my whole ear is red and where the heat tool touched my ear, it has left my ear with a slight 'in dent', which is now blistering...

on top of all that, the quality of her work at fitting the hair extensions was so poor, that i bust into tears as soon as she had left and i had to have them removed straight away. I contacted this lady an hour after she had left and she has offered to pay me £125 for the cost of the service, the actually hair extensions (which i purchased directly myself) and the removal of them, but i just wonderd if i could sue her and get compensation for the burn? my boyfriend took pictures of my ear afte she has burnt it.. please help and advice me.

yes u can sue her.
she has to compensate, she is a professinal she cant do such mistake. its carelessness so she has to pay.

in all honesty you could sue under tort law for personal injury. however this would only be able to go to the small claims court, it will take about half a year for the case to clear, your ear will heal and your extensions have been removed. the court will, most likely, take sympathy with the hair dresser for being forced into this situation over what is, to all intensive purposes an accident and should this be the case and your claim does not succeed then you will not only have to pay your own legal fees but will also have to pay her and the courts fees. because she offered you an out-of-court settlement the court are likely to act in her favour since she took the sense not to waste the courts time, which is already over stretched with other equally trivial cases.
the hair dresser has apologised and offered you reimbursement. If i were you i would take the money as well as the opportunity to realise that if you do take this to court, in the slim chance that you will win you will ruin someones career and thus the rest of their professional life.

First go to the doctors/hospital and see what they can do to ease the pain,and explain to them what happened,then take the pictures and show her the damage,she's caused.ask what she intends to do about it,if she refuses to do anything,phone a solicitor and get their opinion,and go from their,you could take her to the small claims court,but it might be a long process.For the pain try bio-oil its good on burns and helps,you can buy it at most chemists and superstores.hope this helps.I hope this has not put you off hair extentions for good.hope this helps.

Poor woman. She makes a mistake and refunds your money and pays for the work to be undone and you still want to ruin her life by suing her. Go for it but remember when you make a mistake in life that another person has just as much right to wreck your life over a slight burn on their ear. I've been to hospital from mistakes that other people have made but I wouldn't dream of suing someone unless it was deliberate.

yes she should have insurance anyway so this would be paid for by her company and if she doesn't have insurance she will be closed down as you cannot trade without public liability insurance. I would contact a solicitor straight away as it will be easier for them to proceed with the injury still there. You are still the customer and if she has caused this accident to you how many other clients has she burned because she has been incompitent.

you need the advice of a lawyer.

The h/dresser should have insurance cover, public liability for example and any other that covers her work with people.

You should have gone to the doctor any photo taken by a friend can be faked.

I wouldn't bother if she has offered to give you your money back take it and remember next time go to a proper hairdresser who will be covered by insurance

Just think your self lucky that she has offered you your money back!!!

You would go to court and it would more than likely be a civil case as I doubt she is registered company!

Perhaps small claims. Did she say sorry, when she touched/burned your ear?
