Here's the deal: I work 8 am to 5 pm, and my roommate works 3 pm to 11 pm. His bedroom is next to mine, and he watches TV often until 2 or 3 am. The first couple of times, I've asked him to turn it down and he complied, but lately he has been resisting.
He insists that since he pays the rent, he has the right to watch TV after work just like I do at a reasonable volume. He also insists that since I'm the light sleeper, it's not his problem and that I should get earplugs for when I sleep.
I insist that asking someone to turn down a TV after midnight is a reasonable request (especially since our bedrooms are also on top of other people's bedrooms) and if he wants to make noise late at night he should wear headphones.
Who's in the right and who should concede?

In a perfect world he should turn down the TV. Actually, in a perfect world he shouldn't have it that loud to start with just out of consideration for others. However, chances are he's not going to change so you might as well get the earplugs. Sorry.

I sympathize with you, having had apartment neighbors with loud TVs that late.
Another aid besides earplugs is some kind of noise-generator. Something like a fan that makes a steady unobtrusive noise is easy to learn to sleep with but can block out some other noises. One that many people like is the Marpac Sleep Mate, but there are others.
Another option might be to offer to pay for headphones for him. Or buy him a set-up with the wireless headphones that he could also use with a stereo.

He's being a jerk and being stubborn.

However, it looks like he isn't going to change, and if you hope to sleep at all you will have to do something. My suggestion would be to invest in some earplugs and give them an honest try. If they don't work, tell him. At least you will have tried to honor his request.

Then you could offer to purchase headphones for him, or do something else to reduce the noise. Try to put yourself out there as much as possible, since it looks like he isn't going to budge.

I think your roommate should be more considerate. You are right he should wear headphones. If it continues then you will be better off with earplugs this way not only will the t.v. stop bothering but other noises like walking, going to the bathroom, coughing and so on and so on.

I advise you to determine what YOU can do before expecting someone else to change. So get the earplugs. I sleep with them every night and you can get used to them too! This kind of response to the situation is mature and will help you in all kinds of situations later in life. So take it easy and get the earplugs. I use "hearos, extreme" from walgreens.

I was like your roomate, I was a night owl and felt that if I paid the rent it was my right....also, it would be like asking you to go to your room and go to bed at 4pm, could you, would you? My suggestion is to get earplugs they really do work or ask him to get earphone for the television.

Are you sensitive when he is sleeping to making noises that would awaken him? If so, mention that to him while asking him for the same respect.
