You may have to move.. does your Dr understand that? Plus WHY would he write a prescription for a dog... that is totally unheard of... I can see him telling you.. but where would you go to get that prescription filled?

That is a very tough question. What you would probably face is an eviction proceeding in which a lawyer might try to use the Disabilities Act to allow you a dog on a non pet lease.
I don't know if is would be worth the expense, further the Landlord could argue that other tenants will not see an obvious disability and the court might order you to seek another apartment anyway. They might not, but they might. Very hard one to call, and would be expensive to fight.

BTW Jess is in part right but it is not a slam dunk legally. A service dog provides a service, as in a seeing eye dog. A companion for emotional support may be disputed. If the Landlord brought in a Doctor who disputed your's and said you could find companionship that was healthier using another means that wittness could cost you your case. What a court would do is any body's guess.

You don't happen to be in Florida do you? If you are there is a new proposed bill called HB 1373 – Emotional Support Animals
Which basically discuses what you are talking about. It has not yet been passed.

the note saying you should get a dog does not obligate the landlord to allow a dog. It can be an excuse for being allowed to terminate the lease without the normal penalty.

I own property that I rent out.

If someone came to me with a note such as yours I would let them terminate their lease early. I would not permit the dog. No pets means no pets. If you get one anyway... you get evicted.
