Actually, th answere provided by Akbar B is totally wrong. In a public place it is completely legal so long as the method you do use does not harrass, vex or otherwise annoy the suject of the surveillance. Even n that case, as long as you ar in a placeopenly acessable to the public and where it can be shown the subject does not or should not have a reasonable expectation of privacy, nothing can be done other than someone politely asking you to cease. Now, to your uestion; it depends on allot of factors. Where is the "public" place and what is the envionmet? For what reason are you conducting the surveillance? What is the expected outcome of the surveillance? Will you be alone or have a second operative to assit you? Will the surveilnce be conducted in a stationary position or do you expect the surveillance to go mobile? What equipment or resources do you have available to you for conducting the surveilance?
