Is it necessary that we both live in the same state? I live in New Jersey and he lives in New York. We have a child together and would like to get married, but without the huge church ceremony... that could come later. How do we get married at the Town Hall?

It varies from county to county let alone state to state. Call the place where you intend to marry & they will give you all the info.

You will both have to be present with ID.
Some require at least one of you be a resident of their state.
I'm doing a wedding in KY next week & both are from Ohio.
KY's license allows you to get married anywhere in their state, resident or not.
In Ohio if you are a resident, you buy the licesne in the county in which you live. If a non-resident, you buy the license in the county in which you plan to be married.

Call the clerk of courts and ask them what is needed to apply for the license .. You do not have to live in the same state BUT where ever you are applying one of you have to be a resident of the state... I know in Florida both parties have to be there when applying for the license , I am not sure how NY or NJ is but the best thing to do is call them and ask that way you won't waste your time going there.

I think you just need to get the marriage license in the state in which you will be married.

My husband and I both lived in NJ and we were married in NYC, we just had to bring our birth certs and ss cards to the courthouse. All you need to do is call the courthouse in the county you want to marry in, it doesnt matter where you live, you dont have to live in the county you marry in.

Call your local county clerk. In my area, we got our license in the county we lived in, even though we were getting married in another, & we just had to show proof that one of us lived in the county.

most states require that both live in same city and state a minimum of 30 days,at least in Indiana they do.May want to check your local laws for both states.
