A good friend of mine got his car out of the shop on recently. It was supposed to be fixed, but considering what happened, this was not the case. The alignment in the car was way off and he had to hold the wheel to the right quite a bit to get the car to stay straight. He is an excellent driver, so this was not a problem. But, as he was driving down a dirt road, at maybe 35 mph or so, the car started to veer to the left. Out of instinct, he pulled the wheel to the right. The car did not respond. When it did respond, it was too late, and long story short, he ended up in a ditch and flipped his car. He was wearing his seatbelt and was not injured. Now, for my question. He is 17 and has only a permit, but is getting his license within the next two weeks. He did not have insurance or a tag on the car as he was just driving it home from the shop. Considering he will be 18 when he goes to court, what is the possible penalty he may face?

All I know is that he was ticketed for breaking restrictions on his permit, not being insured, and not having a tag on the car at the time. We are in Kansas.

Oh, and I forgot to mention, he has never been in trouble before for anything at all.

In response to the second answer:

There was no damage to anything but the car, which it totaled. He flipped it in a field. We expect he will have to go to traffic school, which we aren't worried about. The garage can't really repair the car anyway because it's basically destroyed in every aspect. He was just worried about jail time which I don't think would be a possibility.. My dad is a convicted felon, and though I no longer associated with him, I've been considering asking him for my friend's sake. I guess I won't have to now. Thank you.

Since the accident happened before his 18Th birthday he will be tried as a Juvenal. But he will be held responsible for the simple fact he should of known better than to operate a vehicle without a legal license or insurance.He will also have to prove ownership of said vehicle. He will have to pay a fine not sure how much. depends on if there's property damage or not. Maybe some community service (that's pretty much the norm these days) I don't think he will have his license suspended though. But they may make him take a driving class before they instate his new licens. As far as getting the garage to pay for the damages. Well he may have a hard time doing that since he didn't take the car back immediately when he 1st noticed the problem. It will be his word against theirs. Good luck with that.
