Illinois state law requires that children under the age of 8 be secured in an appropriate child safety seat, whether that be a car seat or booster seat. Children under age 8 but weighing more than 40 pounds may ride in the back seat with a lap belt only if there are not lap/shoulder belts available in the vehicle to be used with a booster seat. Illinois law also requires chlidren ages 8 to 16 be buckled in a seat belt or appropriate child car seat. Children under age 18 are required to wear a seat belt when riding in a vehicle driven by anyone under age 18.
I feel 8 is too old. We tell them to grow up and act like a big girl or boy, and they still have to ride in a baby seat. My 6 year old cries every where we go. Because Im mean because none of her friends still have to be " in this stupid thing" My children are always in their seatbelts and will be glad when daughter is able to just be in one. Especially with the new baby on the way.
I dont wear my seat belt , I have a medical excuse not too, She begs to just use the seatbelt. But I will follow the law until she weighs enough or is old enough. They can not be comfortable for an older child. I live in indiana
But if you dont use it the way it is recomended its still a fine, even if they are in it. So make sure its strapped in right.

12, over 4' 10". They have to be 12 because then their ribs are sturdy enough. They have to be over 4' 10" because, well, isn't it obvious? The seatbelt's too small and won't protect them the right way. I stopped wearing one when i was 5 or 6, but i would say hold out until they're 9 1/2, because then i'm sure the'll be fine to ride without one. i think that 12 years old is just for riding in the front seat, actually.

Well in my homestate the law is that a child must remain in a booster seat until they are four feet nine (4'9)
Independent of regulations, children between the ages of 4 and 8, or weighing under 80 lbs, should sit in a booster seat.
Read this website: (It is for your homestate)

Illinois law states till 8 years of age or if they get to be 80pounds and 4'9". Most 8yr olds are not that big, so 8 yrs is what most people have to follow.

if you go on to the britax website they have very clear guidelines on car seat safety. if you live in the uk you can be fined for not using the proper restraints in car. a five year old would not probably be old enough yet to leave her seat. the weight only applies if the height correct.best check with the experts on this one. good luck!
