2.they can use fake tan/self tan/make-up
3.some clothes can make your skin look different shade
4.more important is how one is dressed in the photo or what's around;)

I live in Florida...winter is when it's not as hot...some people hit tanning salons all the time. You can change skin tones in photoshop. I would think unless they know you and where you live, someone would have a hard time telling the time of year from just a skin tone in a photo.

No, they could guess what season, but definitively no. There are many factors that would come into play. Tanning beds, skin tone, region where you live.
So if you're thinking, hmmmm could they tell what date this picture was taken in at my trial...then you're in the clear.

difficult, with travelling so easy today, you could get your tan anywhere in asia and have your picture taken in say NYC or north China or North Korea where its still winter...
