The absolute first thing that needs to be done is either or both motorists need to call the police to file a report. In most states it is the law if the damage exceeds a few hundred dollars, so anything more than a scratch, call the police immediately.
Once the police have filed the report, it is usually the innocent party who will call their insurance and they in turn will contact the other Insco who will call the guilty party.
The guilty party may decide to call in advance, to let the Insco know, but it makes little difference. The guilty party does not have to file a claim for the damages to their own vehicle, but may do so if they wish for the insurance to cover it.
That having been said, it is still up to the judge to make the final decision when the case goes to court, thou as a general rule the police is pretty good with their assessment.
