The senate did not enact legislation giving illegal aliens access to social security benefits. I think what you are talking about is the proposed totalization agreement with Mexico. - We have had such agreements with many countries since the 1970's. See:

The proposed agreement would apply to legal aliens who contribute to Social Security while legal. -
One of the main purposes of these agreements is to protect workers who contribute to more than one country's social security system, during their working lifetime - These agreements make sure that the workers will get some kind of prorated benefits from each country when they retire.
