I gave a dog to my brother. I'm hearing from other family members that the dog is becoming aggressive. I adopted the dog from the local pound under my name, but she now lives with him. If she bit someone, could I still be liable?

I'd just get something signed by your brother stating the dog belongs to him.

However, if you knew the dog was getting aggressive when you gave him away, you could be liable.

But why is the dog becoming aggressive? How is being aggressive? Is it fear aggression? Has the dog been spayed/neutered? Has anyone taken the dog to training?
What does it mean when you use the word aggressive?

Since she is physically away from your home I doubt it bUt to be safe esp since the dog is becoming aggressive I would make out a paper listing your name /address,,the dogs name and your brother's name and address and the date approx that you gave the dog to your brother and then you handwrite your name and youe brother should sign as accepting the dog as his and that it lives with him.If he does not then go to the bank and have your name etc notarized and mail (you keep a copy) with certified mail to the County Office where you registered your dog that it has the required rabies shots-sent there also the rabies form that you received from the vet-If you gave the dog to your brother before this was done then mail the lettter to the Pound for according to their records you are the legal owner and if somehing happens with the dog the pound will locate you. I'd also QUESTION OF YOUR BROTHER wHY TH DOG IS GETTING AGGRESSIVE-it is NOT a dogs normal nature to be aggressive but usually mistreatment and.or trained through mistreatment to make the dog aggressive which legally is considered animal abuse so I certainly would cover my back for not only can you be held responsible for any attack by the dog but charged with animal cruelty to make him vicious-everyone knows the reasons why dogs get aggressive and its always caused by humans.

You can't register a dog from the pound but i would get him to sign a piece of paper saying that he is the owner of the dog and that you are not liable for the dog under any surcumstances. That would be sufficient enough.

Was the dog aggressive before you gave it to your brother? I don't think you are liable if you can prove it no longer lives with you. Maybe it will calm down soon. I have a mean chihuahua and I am afraid she will bite someone so I made sure she had all her shots.

If the dog is in your name and not your brothers then you are the legal owner of the dog. You will be liable for anything the dog does to anyone.

If the dog is registered in your name, this could be a problem for you. Has your brother re-registered the dog? It can probably be explained away, especially if you trust your brother to take up for you, but it could still be more hassle than it's worth. Try encouraging your brother to register the dog (maybe if you pay for it) and encourage him to get some training for the dog.

if you can prove that you are no longer the owner then no you are not liable. Make sure your brother registers the dog in his name.

The person whose custody the dog is in at the time of any *unsociable act* would be responsible...

Like when my son was in college... even tho he owned the dog according to AKC.. the dog lived with me and I was the responsible one.. even for her rabie shots.
