That is it will depend, but since it is a sign that you most likely will be driving drunk, most insurance companies treat certain tickets more seroius, this is one of them.
By the way not all states have this as a law, in TN it is still legal to have a open container

get a good lawyer. you're in the south. but seriously, why do you need a lawyer to argue your insurance policy? you need a lawyer for court! and honestly, you will be convicted if you did it - there's not much hope on getting off from that type of charge. what you need to worry about is your punishment, i.e. suspended license, community service, jail time, etc.

if you got a ticket of violating something then maybe yes...were you drunk while driving? if yes...oooppsss...a lot of problems will arise soon...
