My mother claimed me as a dependent on her taxes this year, but I didn't realize this, so I didn't report that I had been claimed as a dependent. I e-filed and already received my return. What should I do?

I'm not under 18...I just graduated college and started a new job. Technically, she is able to claim me, it just didn't occur to me when I was filling out my taxes.

Don't spend your refund if your mom was eligible to claim you. You can either file an amended return showing as not claiming yourself, and send a check with it for the additional taxes, or wait until you hear from the IRS (and you will, and your mother will also). It would be better to just do the amended return now, so you aren't subject to interest when you have to do it later.

BTW, depending on when you graduated from college and started your job, she might or might not be eligible to claim you. If you graduated and started working early enough to provide over half of your own support for 2006, then she would not be able to claim you, and your mom is the one who would have to file an amended return. And if you're 24 or over as of the end of 2006, and you made at least $3300 in 2006, then she can't claim you even if you were a student.

If you were a full-time college student under the age of 24, and you didnt provide more than 50% of your own support, and you lived at home for over half the year (not including absenses for college), your mother is eligible to claim you as a dependent.

You will need to amend your tax return using Form 1040X. You can do this now, or wait until the IRS sends you a letter stating that you need to amend. But if you wait, you could be subject to paying interest and penalties. You should file the amended return by mail as soon as possible.

Better talk to your mother and the two of you figure out what to do.

If your mother is losing a lot of her refund because you aren't on her return, you can amend your return. If not, your mother needs to amend her return and take you off her return.

You don't have to do anything, your Mom is the one whose return will be questioned by the I.R.S.

You should tell her so she can make plans to amend her return.
