I am afraid it should be so. An unfortunate situation, this is - but just a minute, what proof do We have that you would have accepted Jesus in a minute, if you hadn't died? Are you trying parallel-worlds explanations on Us? No, really? (....says St Peter and points positively towards the Gates of Hell).

in that minute did they spiritually accept Him and ask forgiveness i would say no he wouldnt go to hell there is a parable that i was always curious about where the men were laboring in the field and some worked 12 hrs then one went to work at dusk and they all got the same wages Gods ways are higher than our ways

That would be impossible, you either have or have not accepted Jesus you can't die in the process of accepting Jesus.

My understanding has always been that Jesus know what's in our hearts. If, for some reason, we are unable to speak the words, I don't believe that makes the actual acceptance as if it had not been.

Accepting Him isn't enough!. We have to become sinless and get rid of our sin nature. We do this by repenting,baptism by immersion in the name of Jesus Christ, this washes our sins away. To get rid of the sin nature, He will fill us with his Spirit Which is called the Holy Ghost. We will know when we have it when we speak in an unknown language that the Bible calls tongues!!
