i am not sure about the laws in Kentucky, are you on state or county probation, in general a pregnant woman they will go easier on that person, but they will give you a heavier probation which will have more rules, hopefully, they will extend your probation ands watch you more closely. They could send you to jail for 3 days to a week. It is really according to what you tested positive for, and if it is the same thing you where put on probation for. you might talk to them and see if they would help you get into a drug rehab. whatever you do ,,,do not run or try to hide from them hit it straight forward and be truthful with those people. ask for help they think more of you that way...i have been there and done that , that is how i know...

Depends on your probation officer. Obviosly you did something prior to be on probation. To be drug tested usually your prior charge was a drug charge. Becuase you are a first time offender they offered probation with no jail time for the original drug charge. If it is left to the judge failing your drug charge the judger could revoke your probation and make you serve the original sentence. You were given a chance once by putting you on probation. By continued drug use it will show the court you don't plan to stop using drugs. Which is more important yuor freedom or using the drugs? You have to ask yourself is it worth it. If you have a child while taking drugs you jeapordize losing the custody of the child. You might think you can hide it from the courts but you can't hide the drugs from your doctors and medical staff. Continued drug use while pregant is not good for you or the baby. I suggest you stop the drugs now!

Depending on the charge you are on probation for, and if this is your first violation, you may not go to jail. If the drug is from a physician prescribed medication you'll be fine, but I'm sensing it's from illegal drug use. However, the fact that your pregnant, I would violate you if you were my client. Not to be mean, but to keep your baby healthy.
It bother's me that your worried about going to jail (you) and not the health of your baby. When your pregnant you have an obligation to keep from harming your unborn child.
Another thing is that in many States a baby's meconium is tested for drugs, so they can get the help they need in their own detox. A baby's system doesn't purge and therefore the toxic levels of the drugs keep accumulating in the baby's system, unlike your system that purges. When you stop using after a time you will test clean, but your baby won't until after birth. And when a baby tests positive for drugs, you get Children's Protective Services knocking on your door--You should be more worried about that baby, not your own hide for getting caught.
Please find a way stay clean for the next 90 days.

I am a probation officer in Texas and in the counties in which I supervise people on probation if this is their first positive UA will typically put sanctions on them. Our first concern is getting the person treatment and we do that by referring them to our Drug Counselors for a Drug Evaluation and if they feel as though the offender needs treatment they will enroll them in various courses such as: DOEP (Drug Offender Education Program) and out-patient treatments that they are in charge of.
Although, at the same time one of our main concerns is the well-being of the child. In this instance if your probation officer feels that you going to jail is the right move, they can file an ROV and request revocation. Many times if it is your first violation, whether it drugs, fees, reporting...they may be more lenient on you and attempt to get you help.
Although at this point it might be wise for you to admit you have a drug problem and ask for the help, especially if you are pregnant and doing drugs. That only harms your child and your first concern should not be about going to jail but about your unborn child. Therefore, if I were your supervision officer I would probably ask the judge for you to either be put in a very strict in-patient treatment center or to revoke your probation.

you stand a very good chance. it is up to your probation officer. he/she might have leniency since you are pregnant. Or might lock you up for the remaining probation time. regardless if you are 6 mos. pregnant, you should probably try to stay clean for your baby. It may not hurt him or her but then again.....why take a chance?
If you need help staying clean admit yourself into a rehab. Come to think of it....have had friends go into rehab 30 days or so to beat going to jail. but you have to do it before your pos test gets to the judge.
Not to sound harsh but you really should think more about that baby than yourself. that little baby has nothing else but you to depend on. If you plan on keeping the baby, I hope you realize that you will need to put him/her first. There is nothing more devasting than losing your kid(s).
If you want to be a mother, then act like one. Try to be the best one you can be. Children can be the most precious gifts in your life. Raise them to the best of your ability will only make you that much more proud.

Sorry, but you can go to jail for failing that drug test. My cousin failed his for meth after being put on probation, and he was given a jail sentence of 3 months. He's out, but if he fails his weekly test again, it's prison time. This all stemmed from a drug charge.
They give you probation in order to see if you can stay clean. If you fail the test, you go to jail. If after you get out of jail and you fail again, it's prison time.
Another piece of bad news (sorry, no positives in this case) is that if you tested positive on your drug test, CPS WILL TAKE THE BABY AS SOON AS HE/SHE IS BORN!!! You can test positive at the first pregnancy drug test (around 2 months) and they'll give you a chance to clean up before the next one, but being that you're 6 months along and have possibly failed a drug test, they will take the baby at birth if you do not pass the test before delivery. They take a urine sample in the early stages of labor, and if you test positive, CPS takes the baby, and you're ordered to go to a drug rehab program for 30 days after you're released from the hospital. You won't see your child until they are a month old. You may also get jail time after rehab if you violated your probation by taking drugs.

probably, is it your first time, what are you on probation for, what kind of drug was it? and how many more months do you have left?
these are probably all a factor in deciding. i believe it is up to the judge.
doesn't it make you just feel warm inside that if you have a problem, they will make you take drug tests and pay them, and if you can't fix your problem then they are nice enough to throw you in prison with rapists, murderers, and thieves. They only care about you, you see. And don't listen to those people who say that drugs should be legal. people who have addictions are evil! they belong in prison for the rest of their lives!!!! that will solve all of their problems. And, the government can profit off of the prisoners working for them! Everybody wins!

Unbelievable. You are afraid of jail, but you're not afraid of what taking drugs will do to your unborn child? I hope your PO and judge will get you into a rehab program and make sure that baby is taken care of by someone responsible, whether that be you if you clean up or someone who will be responsible for its welfare.

So, lets see now....you are on probation, even though you know you are pregnant you chose to take drugs anyway....
I don't know if they will put you in jail but if they do, I hope they throw the book at you....
