I suggest boycotting PayPal.
They have the most fraudulent system ever.

First question: Yes I have had many many problems with paypal. One being that when I use American Express I am not permitted to dispute any charges when someone does not fulfill their side of the contract. American Express says Paypal is the intermediary and they did everything they were supposed to. The person who didn't was the seller, but the seller was not the person with the merchant account. I am sometimes able to do a paypal buyer protection claim, but only if the seller has 98% positive feedback and atleast 50 feedback (I think). Even if the purchase is eligible for the buyer protection, paypal will not refund the money, unless the seller has the money in their account. For example, If you send me $1000 via paypal for an ebay item, and I withdraw the money from paypal, you will not be able to do a buyer protection claim since the $1000 is no longer sitting in my account. Paypal will attempt to withdraw the money from my checking account, but if they are unsuccessful then you will be unsuccessful as well in trying to get your money back.

Second question: You should be able to dispute the charges (even if you used American Express) because you never authorized the $1200. The only time you will have a problem disputing charges, is when you authorized the charge, but the seller sent you a rock or nothing, or a fake item, etc..

Visa and Mastercard don't seem to care that disputing charges is a violation of the TOS. So if you must use paypal, stick with them only. Never pay anyone with American Express. Never pay anyone with funds from your checking account (that is worse than AMEX), and most of all NEVER EVER EVER pay someone with paypal balance. That is the absolute worst of them all.. Don't do it.

Edit: If your credit card company won't refund the money, then it is time for you to get a new credit card.. If they won't refund the money now they also won't refund the money if the card is stolen, etc.

This also happened to me with paypal. A hacker stole 350 dollars from my visa. Paypal refused to refund the money so I took them to small claims court. They never showed and by default I won. Depending on what state you live in you may be able to do this to. More than likely you will need to file a fraud report with your local police department. Once you have done that have paypal served with your lawsuit. They probably won't show up.

Yes, Paypal SUCKS. Someone stole 200 bucks from me, but I was able to get my money back by issuing a chargeback through my bank that issued me my debit card. Try that if paypal won't help. Paypal customer service is actually useless. I'm never using paypal again.

You shouldn't have any trouble taking up the issue with your credit card company and avoid any costs - provided you haven't failed to inform them in a timely manner of the fraudelent charges.

I've never had any trouble with Paypal and I've used it for about five years. However, I've never had to face this type of problem with them. My only problem has been when buyers send their money to a wrong email address instead of mine and so far it's been worked out.

A hacker by the name of "DARKMATTERI" hacked paypall last November and stole $135 from my checking. Because I never authorized the transaction, my bank credited the amount back to my account.

I would fight it... Paypal gets sooo much money off of every single merchant, they can shell something out for their mistake over crappy security problems.
