Neither of us has filed for divorce. He thinks that my having the kids a week and then his having the kids a week is too much time with me. During his weeks, he has a baby sitter pick them up every night from daycare and cook dinner. He arrives home at 7 and promptly puts them to bed at 8.

You're going to have to fight for sole custody. You will need a good lawyer. The best thing to do is get sole custody, then agree to one or two nights a week and every other weekend, one or two weeks vacation, plus a holiday schedule. Make sure it's all spelled out, including pick-up and drop-off times, in the agreement.
