I just got an car accident today while backing out in a parking lot. Another car was backing out and my bumper hit her passanger side door. There wasn't to much damage to my car a few scratches and a little part sticks out on my bumper. Her passanger side door has a dent size of a big circle. This was my first accident and I have a clean record for the past seven years. My insurance company is All State. My damage is probably not more than $700 and hers maybe $2000. I live in California. Does anybody know how my driving record will be affected will I receive a point??? Any info would be helpful.

I already put the claim in and I told them I backed out and looked both ways so it could've been either person's fault. I don't think it was just my fault alone, because she should've seen me as well. She was in a little sports car 2007 Saturn Sky. I'm really only worried about my rates and my record my car really didn't get an severe damages. Thanks for any info

Do I have to report an SR1 to DMV? It states only if someone is ingured, killed, or there's property damage and none of that occurred at the driver stated she wasn't hurt and either was I? Do I still need to report it? She said she was going or call the police because DMV keeps a record of accidents.

Its a common blame case try to find out if the other person is insured if not get stuck into them frighten them into paying for yours too they had no right to put their car out there where you could hit it . Tell them seven witnesses will be on your side the say that the other car deliberately came out of the parking lot so you could hit it they are covering up the fact the dent was already there. from last week.

What part of CA are you in? I only ask b/c I used to work for Allstate. But it doesn't matter, I'll tell you EXACTLY what they are going to ask you:

Are the parking spaces straight or angled?
Is the parking aisle one way or two way travel?
How far had you backed out when the impact happened?
How far had the other car backed out when the impact happened?
From the time you started backing until impact, how many seconds passed?
Did you hear any horns prior to impact?
When did you first see the other car? If you didn't see them, why?

Allstate is ALL about comp neg (they'll explain it to you during your 9-step interview with your actual adjuster).

Most likely they will accept 50% liability, 75% liability at most. Depending on how you answer these questions, and depending on how the other person answers these questions is where the liability will rest.

IF you are found to be 51% or more at fault AND they pay out $750 OR MORE to the other party, your rates will rise.

If you are found to be 50% or LESS, your rates shouldn't rise.

The point thing only applies with the DMV, and since cops don't respond to parking lot accidents in CA you're fine.

Don't worry....Allstate adjusters are VERY WELL trained in this area and believe you me, they will NOT pay a claim at 100% unless you are 100% at fault, and in this case, you're not even close. Even if the other person's insurance company takes it to Arbitration, Allstate will win....they do the best investigations out there.

You did not get a ticket, so there will be no points added to your record. Most police departments will not issue a ticket for something that A: they did not witness, and B: happened on private property.

Don't admit fault. Leave it to the insurance companies to work out. It should have little, if any, effect on your rates.
