Could anyone please tell me a rough idea of the prison sentance that might be given to someone for the rape of two women and the attempted murder of one of them? And what would be the likely term that person would actually serve - perhaps in Massachusetts?
I'd better explain why I'm asking; I'm in the process of writing a story. I do this quite regularly, but never actually get to write any of them down! Still, they keep me entertained. This particular story is turning out to be quite exciting, so I might just get my facts straight with it!

American sentencing does not follow any logical pattern. It is the vilest and most brutal in the "Free" world. For instance, 2 black brothers got 273 years for having a bit of smoke and more recently a school teacher who had porn pop up on her classroom computer "is expected to get 40 years in jail" .Poor woman. I think it all depends on the moronic and sub normal judges they have there. Its not even worth a guess. Is she mega rich. That is what you should find out first.

If the crime was committed without the inclusion of the crime of kidnapping, then Mass State Law will be the statute under which your suspect will be charged, tried and if found guilty, sentenced. If, on the other hand, your suspect kidnapped his victims, then the FBI becomes involved, and the statutes under which he is charged, tried and if found guilty, sentenced. State laws often ask for longer sentences. Depending on the level of violence in the commission of the crime, your suspect could face anywhere from 5 years to life, without chance of parole. The charges you mention will have a mandatory sentencing requirement as far as time served is concerned. To find out what those would be, you can Google whichever state's laws you need. Under federal guidelines, the sentences for violent crimes have more lenient parole requirements. In most circumstances, the attempt murder charge would probably be dropped, as the rape charges would bring more time, and it's fairly difficult to prove attempt. In a case where kidnapping became a charge, that charge would be kept, as it would be evidence of premeditation and intention. Kidnapping is considered a very serious offence, and is treated as a crime of violence, and is rarely plea bargained, or dropped. Good luck with your story.

It all depends on the facts. Generally this is a very serious crime. If he is sentenced consecutively for all three crimes he could face up to 30 or more years. That means he will serve for all three crimes.

I would talk to someone who actually is in prison for this if you want to get your facts straight. Prisoners will talk to anyone who will listen and are an excellant source of information on prison life. Since that is what you need for the book. Be very careful though. I would only use a PO Box and not give out any information about myself.

Call your local public defenders office. Ask if you can take one of the attorneys out for lunch to pick their brains for your writing venture.
