his mom has full custody she is going to call the cops because she doesnt want him to be with my dad can he get in trouble he is scared to go back she drinks all the time and argues with her boyfriend he wants to stay with my dad can he or will he have to go home.

That is a tough call based on the information you gave. First of all why does she have full custody? Is your dad any blood relation to your brother? Can your brother substantiate his claim about his mother through neighbors or police reports? Is your dad presently married and can he provide a stable home for your brother?

These are the questions a court will want to know before they will make any changes in custody. Also you didn't say if your dad wanted him to come and stay.

Your best bet would be for you brother and your dad to go to the child protection agency in your area and ask for their assistance since your brother is still in their jurisdiction.

what you need to do is call child protective services in your county, and your Dad needs to file a petition in family court, requesting custody of the children, as you mother apparently is an unfit parent. Good luck.

Don't waste time. Do it NOW. Tell you Dad to get on it as well.

Your dad needs to call the child protective agency in your area NOW.If you get them involved,they will investigate the situation.
You might even get a temporary order of custody.
