Is it legal to record a conversation without the other person knowing?

May vary in certain places, but...

You are allowed to record an "in-person" conversation, without permission. This is NOT covered under wire tapping laws, which prohibit recording phone conversations.

If you think about it, this happens all of the time.

However, if someone states "no recording," then it would be illegal to do it anyway. Law enforcement, particularly under a judge-approved warrant, may be to do it regardless*.

* No, it's not true that if you say to an undercover cop "are you a cop" that they have to say "yes."

I'm sure each state has varying laws concerning this matter.

I know in CA you can't without a warrant or a court order. I had to specifically request permission from the court in order to record any conversations I might have with my soon-to-be-ex husband even though I have a restraining order against him.

Yes, because you are in public. However, if the dinner takes place on their property, you must have their consent.
