I am trying to take my ex to court over child support issues. What happens if the sheriff is unable to deliver the summons cause he is avoiding it? How many times do they attemp to deliver it and if they can't deliver it what would my next step be?

If the sheriff is unable to serve the summons you may hire a process server to do it for you.

You are not permitted to do it yourself.

It may depend on the local ordinances, but if the Sherrif makes an honest effort to serve the papers but is unable to do so, the court will still set a date as it is not mandatory for him to be there.

Also, try give them information such as his employment where he can be servced upon going into or from work, or a place he may frequent.
