I work on a commission basis, the commission is based on job profits, I have discovered that the company is coding laborers as secretaries and sales people, thus reducing the workmens comp rate. They are charging a higher rate back to the jobs. they are also lying about the hourly rate they are paying some of the laborers in order to get a lower rate. What can I do?

I would file a complaint with the State Labor Board and State Insurance Commission. If there's a separate state agency that manages worker's comp, I'd file a complaint with them as well. If you don't get any joy there, contact the State Attorney General's Office.

What they are doing is outright fraud. It will eventually come back on them when one of those "secretaries" is injured on a construction site or while operating a forklift but you shouldn't sit idly by if you have knowledge of a crime.

Tell them to stick it. . . . There are plenty of employers that play bu the rules. . . I used to work in sales as an outside salesman. The small company had us pay our own taxes, as they wanted us to be independent contractors. I suffer now because my Social Security check could be higher had I worked for a company that paid into FICA [S.S.].
