in tennessee the sentence for 2nd dui is usually 45 days in jail and suspension of license for 2 years. i know from experience unfortunately. however tennessee has a program called ADAT (alcohol and drug abuse treatment) and with multiple dui's you are eligible for a 28 day inpatient treatment program and it counts as jail time. but your lawyer has to ask for it. there might be something similar in your state. usually if you graduate the treatment program the judge will suspend the rest of your sentence and you will walk with 2 years probation and 2 years suspended license. however when you get your license back you have you have a breathylizer installed in your vehicle for 6 months. keep in mind this in tennessee - you can go to californias dmv website for more information concerning your state.
everybody makes mistakes, all you can do is get help, go to treatment, stay sober, and make the next right descision. i hope your friend learns his lesson, jail isnt fun, and neither is the alcoholic lifestyle.

I don't know the true answer so I'll just give you my findings. I will put him jail for 6 months and fine him a total of 2600.00 bucks. I will also take his driving rights away for 5 years. He will have to enter an abuse class and finish it before he is released from jail. Why was I so harsh, to keep him from killing someone who is on thier way to work, school, or the doctors office or worse yet a family of 5 on thier way to vacation. Case over, Next alky please.

Excuse me, I'm a Californian who has to travel the highways
with drunken "friends" like yours. These kinds of friends have
killed 1,000s on our freeways. I don't feel the least sorry for
him if he gets locked away for good. But he will probably get
his license taken away for 7 years--jail time 1 year. And when
he gets out he will do the same thing (I just hope he doesn't
splatter a poor child all across the road.

It depends on how drunk he was, in any case he wont be able to drive for a long time, he will have allot of fines. Well if his lucky, and with an great criminal attorney, he might get probation and some community service, fines, if his lucky with a great lawyer..

Hopefully they'll stand him in front of a wall and shoot him.
More likely they'll give him a fine and probation. They'll take his licensee away for a year but he'll drive anyway (drunk again).
Hopefully when he drives drunk again he'll run into a bridge abutment at 100 mph and make Darwin happy.

with any luck they'll lock him up and throw away the key.
your having to enrol him in a.a. instead of him being man enough to do it himself tells us a great deal. he doesnt care about anything or anyone other than himself. sad actually

if he is lucky probabtion before judegement. if not then weekends or weeks in jail. also license is going to get revoked probably like 45 or 90 days. your friend isnt Nicole Ritchie is it?

As bad as people drive sober, they drive even worse drunk. Lock him up for a long, long, long time.
