Leviticus 5:2 " 'Or if a person touches anything ceremonially unclean—whether the carcasses of unclean wild animals or of unclean livestock or of unclean creatures that move along the ground—even though he is unaware of it, he has become unclean and is guilty."
Numbers 19:11 "Whoever touches the dead body of anyone will be unclean for seven days."

I dont think you can enter into marriage with someone who has died (s/he is unable to consent), and sex outside of marriage is fornication. Further, the Bible makes it pretty clear that the marriage covenant ends, as modern wedding vows suggest, with the death of one spouse (freeing the surviving spouse to remarry of he/she so chooses. I corinthians 7:9)
Therefore, other considerations aside, this behavior would be sin, because it would always be outside the coventant of marriage.

The two shall be one flesh. If you don't mind being dead too go ahead. Also if one has sinned and has no intention of repenting, they are dead already so relations with them would be basically the same thing.

The bible merely says to flee fornication (1Cor. 6:18). It doesn't matter whether it's with men, women, the living, the dead, animals, or your hand, it's all fornication.

I think that the whole concept of no sex before marriage pretty much covers dead people.
