The reason for this is that we owe this particular bank money on an old account. However, the account that this check is drawn on is his employers and these are earned wages that the employer owes my husband. Can the bank refuse to cash it because the person named on the check owes them (the bank) money?

Wow, I'm surprised he had the audacity to go in there and cash his check. I wouldn't have chanced it.
I think it depends on what State you live in.

The two options your have is to pay the old account or go to a check cashing facility. Either way you are going to pay money. You cannot open another checking account because banks will always pull your credit report to check on these issues.

There is only two ways I can see you getting out of this without paying money. One is if the employer will pay your husband cash. The other is if you can find the bank that does not care about money owed on another bank account, which is unlikely.

Take his next pay check and open up an account at another bank and make payments to the one you owe.I am surprised that they even cashed it.They have the right to keep it as payment or if you owe them less than what the check is then they would take from it what you owe them and give you the remainder.So you are lucky they gave you his pay.

yes they can refuse to cash your check. you owe the bank money, and whatever money comes thru them has to cover the negative first before they will give you money. if you dont want that to happen then you can go to the bank on which the check is drawn on and cash it directly, go to a check cashing place. warning: if you let your account stay negative for too long it will be sent to collection, and that will destroy your credit and your ability to get future accounts with ANY banks.

yes they can refuse because you owe them money i suggest that you make payment arrangements with the bank and open up a new account else where because they can seize those funds that you are cashing. also you make be on checksystem which restrict you from opening an account at other banks for 5 years.

yes the bank can refuse to cash a check if they are owed money. just pay them the money or find somewhere else to cash the check. good luck.

I'm surprised they didn't tell him they could only accept the check for deposit. They would have then immediately invoked the most ignored item in the 'terms and conditions' of his account. That would be the term that allows them to seize his current deposits to collect for the old account. I've read enough account agreements to GUARANTEE that clause IS in there.

And yes, they can refuse to do business with him until he pays them in full.
