I know this is not really the right section for this question, but I thought you guys might know something about all of this.
I was just doing some research for my brother. Here's some brief info: He was 16 when she got pregnant, she was 19. She already has a two yr old. At the time she was pregnant, she told him that he was not he father. She moved out of the state, had the baby, and then called him and said he was. She was friends with my sister before all of this happened and my sister says that she is had a lot of "partners". My brother is only 17 now and her step father is telling our family that he should be saving up the child support for the amount he "owes" her since the child was born. There has been no court orders and she's not even in the state. My brother hasn't even gotten to see the baby. Can he really be charged for a baby that might not be his? And who would have to pay for the DNA test? She's the one has admitted to sleeping around. He is stressing out.

when it comes to child support it can get tricky and sticky. It depends on what state you are in there are different rules and regulations. The first thing your brother needs to do is go to your local child support agency and get info. He can request a paternaty test which will clarify who is the father that will elimate the girls father calling and harrassing him ( do not let the girls father harass your brother she is an adult in the eyes of the law your brother is still a minor if this continues get a restraining order on the father). If you get a test and your brother isn't the father, the girl has to pay for the test, if he is the father then he will have to pay for the test. Being that he is a minor with out income he my not have to start paying yet. But you should get the ball rolling on this dont let this girl and her father dictate your brothers life. If he is the father he needs to get a job, stay in close contact with the local child support divison and if that girl or her father has any thing to say have them talk to the child support officer once a case is open your brother will have a worker to help him with future issues with this girl and her father. But if they continue to play ruff and dirty remind them that your bother was a minor and she was an adult when they had sex and you can press charges on her for having sex with a minor( all states are cracking down on that) Good luck if you need more info just im me

Hire an attorney in your state to get a court order for paternity testing. If the child is his he will end up paying the fees but if not then there is legal recourse to have her pay and possibly, liable & harrassment etc.

This would be the sure fire way to resolve this question. Another thing if it is his child does he want custody? Load the guns and go for it. More and more fathers are gaining custody of their children these days. It is something for him to think about. Since she lives away from him then if the child is his and he wants visitation then these issues also have to be addressed.

Not much of a case for your brother, let her get a court order for the DNA test. If he hasn't taken responsibility for the paternity then its up to them to prove it. Look into the possibility that because of the age of consent in your state she may have been guilty of statutory rape. That might be enough to shut up the step dad. It sounds like your family might be the best chance they have of getting any money, but that doesn't mean you have to let it be easy. All it takes is one lonely sperm cell to battle its way through and your brother could be the father of the baby. But the odds of them going through the courts is pretty small, and without a court ordered paternity test, you don't admit it and you don't pay it.

she would have to go to court and request support and claim he is the father of the child
he would have to deny it if he believes he is not
they would have to take a DNA test to prove if he is and each person would have to pay for their own test.
if he is not the father ... no worries
if he is the father...it is up to the judge to decide on support and visitation
so if he thinks he is not the father he should avoid the calls from her and her family...have his parents tell them to stop calling
if there is a chance he is the father, it might be best to get it all over with and do the DNA testing so he can move on with his life either way

first is he listed on the birth certificate as the father.. if so he will have to pay until DNA test is taken and if he is listed he will have to pay to for the test to prove he is not the father.. If he is not listed as the father there's not much she can do until she proves he is the father... as to what he owes unless there is already a court order for him to pay childsupport he owes her nothing. He will have to start paying from the time the petition was drawn. Women need to really stop playing these games! they really do! from my pic you may assum i'm a guy but i'm really a female. and I myself am tired of the games that women play with this men and their babies... hope all works out..tell your bro to keep his head up.

They have District Attorney especially for things like this. Yes, he can order a public attorney of legal aid. Maury Show. She could have put his last name on the birth certificate. Call Legal Aid. Yes, he should be concern, but do not worry. Get all the information about her last name SS#. child hospital ask the hospital name of the child or do he know? Court order can be issued and should. Get the address were the woman lives too.

She would have to petition the court to order a DNA test, I believe at her expense. If he's proven to be the father, they can make him pay child support and possibly even for the test.

FIRST OF ALL YOUR BROTHER NEEDS TO GET A DNA TEST DONE. I SUGGEST THAT HE RETAIN A LAWYER & HAVE THEM SUBMIT A COURT ORDER FOR THE BABY'S DNA SAMPLE TO MATCH WITH YOUR BROTHER'S TO FIND OUT IF HE'S THE FATHER. IF HE DID NOT SIGN THE BIRTH CERTIFICATE HE HAS NO RESPONSIBILITY. NO ONE CAN MAKE HIM PAY ANYTHING UNTIL THE DNA HAS PROVEN A MATCH & THEN IT'S UP TO THE COURT SYSTEM.

He owes nothing until she can prove he is the father and gets a court order. Its up to her to go to court and get a DNA test ordered.

And, if the DNA test is positive, she can be charged with statutory rape because he was underage at the time.

it doesnt matter if she had been sleeping around or not, the DNA test will prove who is and who is not the father. some states pay for it, and some states dont. some states pay for the first DNA test only.

every state is different (slightly) about this matter.

personally, i would want to know if that child was mine, but thats just me. that could be my blood.

as for her being in another state, that has nothing to do with anything with todays child support laws. todays states are connected and all follow federal child support guidelines.

i would just call her and get it all straitened out, no matter what it took. i would want to know if that was my blood. i would also want visitation of the child if it was mine.

and today, parents can NOT deny visitation to a parent. nope. they can get in big trouble if they do it.
