I received a summons for a credit card dept I had with Chase that was purchased by Worldwide Asset Purchasing LLC. I want to try and reach a pretrial settlement with the, but need some help. Should I contact them or there attorney? Also, what would be a good number to offer for a settlement that they might accept. Principal balance is 1573.13, 445.02 interest, 235.96 attorney fees. Also if I can't work anything out with them, how would I got about issuing a motion of discovery? This doesn't qualify for SOL either unfortunatly. Also I live in Missouri if that's any help.

You have several good answers on dealing with them as far as settlement.
I just wanted to add that even if you plan on a settlement - you NEED to answer the lawsuit !!!!!!
If you do not answer, they will automatically get a default judgment (even if you come to a pretrial settlement).
You need to use the Missouri RCP (rules of civil procedure) as an aid in your answer. If you have problems answering, you might contact your lawyer, NACA.net or legal aid.
If they have violated in any way, either by their written correspondence to you or by violations in reporting on your credit reports, you might include counterclaims against them in your answer.
The next thing I wanted to add is that IF you do come to an agreement with them - be sure to have that agreement added to your case file. DO NOT depend on "them" to file it, either do it yourself or go with them and watch them file it, then ask the court clerk for a complete copy of the file. (filings have a way of getting "misplaced")

Id contact their attorneys and see if they will settle with you. Sounds like youre in for around $2200. I think half that is fair. Tell them you are willing to settle for $1000, and that you will pay in four monthly installments of $250 each, and that it is all you can afford to pay.
IF they accept, here is what is IMPORTANT: Dont just pay them and walk away. Demand a withdrawal of the case right then and there. Anything in writing saying they will not pursue the case against you. Either that or they can take your money and still sue you for the balance, as they attempted to do to me once.
In the future, avoid Chase Manhattan and Providian. They are the worse CC companies out there.

If you are planning on contacting an attorney, which is what I would do, I can help you get access to one in Missouri for a very low price. They might not even have o go to court, but settle with the company for you. Let me know! Good luck!

I was sued by Capital One credit card. When I got to court, their lawyer talked to me out in the hall, outside the court room, I didn't go before a judge or anything, we sat on a bench and came to a payment agreement, which was a certain amount per week. I think it was like $40 per week. Your bill is only $500 more than mine was so you'll probably be ok. You can ask their lawyer if you can pay it off in one discounted lump sum, sometimes the companies are good like that.

we went through this and got papers to go to court.we called the lawyers and they set up a payment plan with us instead of having to appear in court.If you miss a payment then they issue court papers again,which luckily that did not happen to us.They asked us what a good payment was for us.I agreed $100.00 per month.It all worked out fine and we have been paid in full now for 11/2 years.we owed just under $2,000.So call the lawyers.They don't want to waste their time going into court either.They just want their money.Good Luck

Just go to court and they will work everything out for you there. This just happened to my nephew and he just had to pay one payment and he was done with it. Good luck and don't worry.
