As a retired lawman. I can answer your question with one word..
Lawyers ! There is big money in defending people. remember the Judge is a lawyer and the lawyer is well... you get it. Example;
A lawyer is appointed for you. He is going to be paid $200.00 bucks an hour for at least six months.He may see you once before trial. He could make as much as ten grand for his trouble. He gets you off with just a a six month sentence.Each lawyer in any given city may have as many as twenty per month. The more he can get into prison, the more he will see again. Weird, but true

In most states there is the "three strikes rule". If someone is found guilty of committing 3 felonies, which includes possession of small amounts of drugs, there are mandatory sentences.

We also house the mentally ill instead of hospitalizing them. They get little, or no, treatment in jail.

Because the penalties for breaking the law are obviously not tough enough - too many repeat offenders.

We need a system that is so tough no one want to ever go back.

I propose the C.C.S.W. evolutionary system of gradual reinstatement to society.

Because we do not punish criminals enough to provide them with a great enough disincentive to commit crime.
