It's a really long & sad story, but let me get to the quest. My sister is in the pen. She's a felon on mult. convictions & has a bf that's a convicted & wanted violent felon. She has been looking for someone to parole out to from the pen, but has been lying to our mother about the rules involving it continuously to her. Our mother had to go to the local parole officer to find out the real rules and regs. of paroling out to someone and refused since there's a 99% chance my sis won't follow them. Anyways, my sis & her bf have been trying to get our mother to lie to the parole board to help her get out (A felony on my mom if she did). It turned out this morning that they had went around our mother & decided to lie & use her ADDRESS AND CONTACT INFO for her BF. You can't parole out to a wanted felo. The parole board called me thinking I was him and wanted info. I told them the truth about this. I am scared he's gonna kill me or my mom. Which of the above should I get? Both? Help Please

I don't know where you are writing from, but locally ( ontario, Canada) there is a small but very important difference in the two. A protection order, ordered by a judge, requires the police to get involved as soon as possible if the subject of the order is in danger. A restraining order is issued to keep someone away that you don't want to have near for fear he may hurt you. In your position i would be getting both foe you & mom is best.

A protection order, restraining order, and ex-parte are basically the same thing just different terminology.
They are issued by a judge, and are in fact a court order restraining an individual from certain acts that the judge defines. In some jurisdictions they may be difficult to obtain, because you are asking a judge to infringe upon someones civil rights (where they can go, what they can do, what they can say .....) but if you have evidence and are able to articulate your situation there may not be any problem whatsoever. Where i reside the ex-parte is a temporary order good for about 14 days (may be more or less) at the end of which there will be a full court hearing to either extend, or drop the request. They may be issued in the jurisdiction in which you live, the respondent lives, or the jurisdiction in which a qualifying incident occurred.

I think they are one in the same...but I would call your local law enforcement office (NOT 911...the non-emergency line) and ask...and then go swear out a warrant for protection...hopefully, these idiots will never get paroled...I'd say you're safe as long as they are behind bars. I think the parole board is going to want a whole lot more than just the prisoner's "word" about where they will be living...
You were right in telling the truth. I think their chances of getting out are slim and none now that they know for sure they lied...

I don't see any problem for you or your mother. Those freaks behind bars are another thing altogether. Just make sure your mom doesn't agree to do what they are insisting she do. And, you keep a close watch on it. You were right to set the parole boards straight....it will be the freaks who will be in trouble for providing false information.

You got to go to the courthouse to get either one. The people there can help you figure out which one you need.

After you get the orders, you got to have them served on your sister or her BF. Otherwise, how do they officially know about them?
