if it were me id break down and find a way to shell out the extra bucks to buy him the proper car seat.. id rather have wasted my money there than having my child be in a car wreck and getting seriously injued because of it.. but if hes that stupid id be going back to court too (which could be months of this child in the wrong seat) so buy the seat take him to court and fight him out there because if hes not willing to ensure the child safety because of the extra moneyw ho knows what ll happen down the line

Yes, there are laws governing the use of proper sized car seats. As the child grows, the parent must provide the proper sized car seat for ultimate safety. If your friend cannot convince the father to upgrade the car seat, she must instantly contact her legal representative and get her case heard in court. Wellhere at least...if you don't have a proper car seat they won't even let you leave the hospital with your infant...so I imagine that if you can get the stats on the seat and submit it to court or the police or someone...he'll be forced to buy a new seat.
He may have a court order for joint custody and visitation...but no court order in the world would allow a child to be endangered.
By the way ..what he's doing is called Child Endangerment and at least here...yes he can absolutely be charged and he can even have his rights to visitation taken away from him.
Tell her to call the police station and ask what she can do.

Yes you can be arrested for child endangerment if the child is not in a proper seat. If I was her.. I would have a cop called to the home before he is to pick up the child and make them police tell him to get a new seat before he is allowed to take the child. Child safety is important to me.. I can not stand seeing them run around in the cars. I have worked in a hospital and there are to many unnecessary deaths of children. One woman just so drunk with her 2 kids in the car with her and she placed them in the wrong seats.. one was a 4 month old and the other was 2 and she lost both of them in a wreck.
Individuals who are convicted of child endangerment face imprisonment, fines and loss of custody of the children they have endangered.

Yes he can be charged if your friend can get ahold of information on the car seat such as the weight , if the weight under the carseat info does not match with her sons weight then yes he can be charged.
My cousin got a ticket for having his daughter in a seat to small for her

Contact your local police/fire station......in the U.S. they will give you a free car seat that is the appropriate size for your child....you are asked for a 20 dollar donation, but it's not required. Have her get the car seat and give it to the dad.

Not sure about Canada, but I would immagine in the US if the cops saw you had your child in an improper seat you would be charged with child endangerment....call your local poliece station and ask or your local child advocacy center and ask.
