2)The punishment of adultery and fornication is another concern for people, as I have already explained is so popular in Britain. The punishment for fornication is 100 lashes and the punishment for adultery is stoning to death.
People shout “barbaric religion”, do you not see if someone is not happy with their marriage then Allah has given them other options which they are free to use (i.e. divorce).
Adultery has to be proved in a specific way, someone can not just claim that their wife or husband has committed adultery and the Muslims gather round for a stoning.
And those who accuse a chaste women, and produce not four witnesses, flog them with 80 stripes, and reject their testimony forever, they indeed are the Fasiqun (liars, rebellious, disobedient to Allah)
Quran An Nur Chapter 24 Verse 4
The above verse is self explanatory, accusing a women of adultery is no small thing and so at least four witnesses are required. Those people presenting Islam to you only present what they want you to see and not the whole picture.
There are also measures in place if your partner accuses you of adultery,
And those who accuse their wives, but have no witnesses except themselves, let the testimony of one of them be four testimonies, by Allah that he is one of those who speak the truth
And the fifth (testimony) (should be) the invoking of the Curse of Allah on him if be of those who tell a lie (against her)
But it shall avert the punishment (stoning to death) from her, if she bears witness four times by Allah, that he (her husband) is telling a lie.
And the fifth (testimony) should be that the Wrath of Allah be upon her if he (her husband) speaks the truth.
And had it not been for the Grace of Allah and His Mercy on you (He would have hastened the punishment on you)! And that Allah is the One Who accepts repentance, the All-Wise.
Quran An Nur Chapter 24 Verse 6 - 10
You can see there is no room for anyone to be “trigger happy” and start stoning everybody we suspect of adultery.
However lets take a look at previous scriptures and we find that they require the same thing.
If any man commits adultery with the wife of another, and defile his neighbour's wife: let them be put to death, both the adulterer and the adulteress.
Bible Leviticus Chapter 20 Verse 10
If a man is found sleeping with another man's wife, both the man who slept with her and the woman must die. You must purge the evil from Israel
Bible Deuteronomy Chapter 22 Verse 22
You can see Islam is not the only religion that punishes people severely for adultery.

If a person is married and get indulged in illegal sex...
First of all it is disobedience of God, cheating the spouse part is secondary.
Punishment.. If this act is witnessed by 4 trust worthy people then adulterer should be stoned to death in presense group of people.
If not witnessed by 4 person than this should be exposed and be kept hidden
Why....
Well this is what is the ruling.

as for your question, it should be clear, on one hand, that repentance wipes out all sins, major or minor, as long as a person does not associate other partners in worship with Allah. Allah says in the Qur'an: "Say: 'O My Servants who have transgressed against their souls! Despair not of the Mercy of Allah: for Allah forgives all sins: for He is Oft-Forgiving, Most Merciful'" (Az-Zumar: 53). Therefore, the gate to repentance is wide open for all people who committed sins, including adultery.
On the other hand, a Muslim husband or wife is not permitted to maintain the marital life with an adulterous spouse unless the latter sincerely repents and becomes a good Muslim.
"Adultery is one of the most heinous of sins in Islam. No Muslim is permitted to cohabit with a spouse who has committed such a heinous sin. Allah says, "Vile women are for vile men, and vile men for vile women. Good women are for good men, and good men for good women; such are innocent of that which people say: For them is pardon and a bountiful provision." (An-Nur: 26) Therefore, to cohabit with a person who is committing adultery is sinful. It is repugnant to one's Islamic sense and sound nature.
If the adultery of a spouse is proven or there is a confession, the spouses must immediately separate their beds. However, divorce does not follow automatically. For divorce to take place, it must be pronounced or committed in writing.
If the wife has sincerely repented and the husband is convinced of it, then he is permitted to keep the marriage. However, if there is no sign of repentance, then it is not permitted for a Muslim to keep such a wife or a husband, as the case may be."
