If workers comp covers your situation, you can't make a lawsuit. That was the point of the development of workers comp is that they would develop an amount that you would receive for each type of injury and you would automatically get compensated for that, but couldn't sue the employer.
However, I'm a little confused because I don't think a car accident would fall under workers compensation because you wouldn't be suing your employer for your injuries, you'd be suing the other person involved in the car accident. Regardless of whether the other guy died, you can collect from his estate for his negligence, unless of course he doesn't have any money to collect. Ultimately, there are lawyers that handle every sort of case, so you will be able to find one to help you... find a good tort lawyer in the area and go explain them your entire situtation and they'll tell you whether you can do a lawsuit or not. Were you on the job when this accident occurred? If so, your labor and industry division should be handling the situation. If you want to receive a permenant disability award, you should contact a lawyer educated in worker's compensation law, otherwise contact a civil lawyer.

NO NO NO ! ! ! Get a lawyer ! If you don't have one you will get SCREWED ! Contact any civil lawyer in your area and if he doesn't take work comp cases I'm sure he knows one who dose. Ask the attorney for a break down of his history with work comp settlements. And above all else document any and everything you can. People,places, times and dates. If you have insurance, then your insurance company already has a lawyer for you. Give them the information.
If you don't have insurance, contact the other parties insurance and file a claim with them.
