My current husband adopted my daughter and he will not give up parental rights for her to change her name, can she still change her name without his consent?

Yes, she can. She needs A parent or guardian... Not both.

It does cost money, but not much. I've included a link to a generic form for change of name for a minor, and it includes prices. However, you'll want to find specific forms for your state, as the generic version isn't guaranteed to be accepted in all states.

I'm not sure about right now, maybe not for a few years. But when she's 18, she could change her name to whatever she wants to.

She could probably have it changed by deed poll.
