Call or email the manufacturer of the toy. If they bend over backwards to try and help you then it means they know they are at fault and are trying to keep you happy. Then call a lawyer and tell them your story.

Anyone that gets hurt with a child's toy being an adult should not be using the computer or you might get into something that might get you hurt or wind up in the wrong web site

Of course you can. That does not mean you are going to win. Allways remember its not the lawyer that makes the decision in court its the judge. A lawyer can promise you the world but its the judge that decides how much of the world you will get..If you lose you pay the lawyer..

I wouldnt bother with it. And try not to be sue happy about everything. It gets you nowhere.
