Does he have this right since we are no longer together? Can he take this to court and fight it?

First and foremost were you 2 married? If not I do believe you gave birth to those kids and if you wanted them to have his last name you would have given it to them. I went through this crap last year w/ my ex, he doesn't even call for the past 10 years and the courts were giving me hard time so let me just say "I had to do what I had to do" and my son has my last name and now he's looking like a real big a** because he tried to fight me and I still came out on top. Baby Girl do what you have to do he can't fight you because (i'm assuming you 2 weren't married) so legally he can't do sh** but take it.

Did he sign their birth certificates?? He could take it to court, but if you have custody and he signed the birth certificates with their names as they were he probably won't win.

No he doesn't have the right. What makes him so special that they should have His last name and not yours?

I'm not really sure of this, why don't you have his last name as their second last name and have yours be the first. I'd bring this up.
Do what you please, and if he wants to take it to court and it's in his favor I'd see it as a male superior thing.

in my point of view, why the last name not his when thei child are born ? i would say just keep it to your own.
