How long would a person be in jail for behind it?

It is in some areas. In a few of my criminal justice classes I have heard laws that state if a mother hears you swearing infront of her children you could technically be arrested.

Is it enforced? No. Unless anyone here has been arrested for it (I highly doubt it).

If it is done in a public place it can be. It is usually a low level offense such as "Disorderly Conduct". The law states where I reside, in part, that anyone using abusive or obscene language which is likely to cause alarm can be charged with a misdemeanor. Remember that in this country you have a lot of rights and freedoms including the fredom of speech. However, you do not have the right to infringe upon someone else's rights and freedoms. That is why you can't legally yell "FIRE!" in a crowded theater, despite the first amendment freedom of speech clause. A lot of people would rather not hear your obscenities and may be offended by them.

Here in Canada the only way that you are going to be in trouble for swearing is if you do it in public and cause a disturbance by doing it. The maximum fine in $500 and/or six months in jail, but this would very rarely happen, as it is considered a very minor offence.
There might be local by-laws in place about this depending on where you live where you might get a ticket for it.

There are blue laws still on the books in some jurisdictions, prohibiting cursing in front of children/women/whatever. An 1897 law in Michigan got a chap in some trouble about eight years ago - the law was later overturned, basically for violating free speech rights.

There are some pretty amazing laws still technically out there, but pretty unenforceable.

Well, we do have freedom of speech, but years and years ago, states were prone to have some faulty laws on the books. There are laws against walking on sidewalks on Sundays, in some states. There is still a hanging law on the books in the state of Arkansas, thats been there since the early days of statehood.

But the chances of going to jail over cussing is slim to none unless the police were dealing with an idiot. You know, one of them unusual chance meetings when some cusser was distrubing the peace, he was warned to shut up, so now he's cussing the police. Yea, they can take him to jail..........

cursing is not a crime but the court will interprete that to a "disturbing the peace" and that is a real crime

Freedom of Speech...but u gota be logical bout it...like not in front of a bunch of kids and not in a court...or with a police officer giving u a traffic ticket!

It is profanity in public which is a public nuisance same as drunkenness and generally it is a misdemeanor offense
