good question. Using limewire for example is classed as 'illegal' but so is riding a bike on the pavement, or peeing in public etc, but people still do it. 99.99% of people using limewire won't get busted, due to ISP privicy rights of people's information, i.e. not letting the police get access to them without enough serious evidense. The general people that do get caught are those uploading onto bittorrent file servers. using trackers I think its easier for them to trace. Theres alot of people (millions) using this kind of software to download 'illegal' files and its impossible for the police to arrest everyone as you would need a country as a prison. The corporate companies and police are mainly after the software giants, check out piratebay.org legal threats link and see how they're 'trying' to take them down, but they haven't got a chance. Hope that helps, not trying to influence illegal downloading by any means, but the money these big companies make, this doesn't scratch their pockets.
