They should not need to warn you either way. You are ordering a hot or cold drink. I would think you would expect it to be hot or cold. But the dumb lady sued over hot coffee, so they do this to protect themselves from her and the dumb judge who didn't throw it out of court. I expect that if someone sues for a cold drink, they will begin to put that on the cups too. If fact, if it were me, I would do it before someone decided to fund their next vacation at my expense by suing because their drink is cold.

you should totally sue starbucks over a frapaccino brainfreeze and see if you win! If you do, then all the drink places will have to put warnings on the cups for extreme cold, thats how the hot drink thing got started.

Because the sensors (tastebuds and other nerves) in the mouth are much more tolerant to cold temperatures than hot.
Although, I cannot drink extremely cold drinks because my teeth cannot tolerate too much cold.

Just BE CAREFUL when you accept a hot coffee from Mickie D's! That lady who burned her lap at the drivethrough who filed suit against McDonald's is still recounted in the court system.

Actually, 7-11 has a warning on the cups! Doesn't help me, even if I sip that concoction a little slurp, I get a brain freeze!

Er, I don't think you ever get drinks served that cold. I can't remember ever having one that even stuck to my lips, but I've had blisters inside my mouth from ones that were too hot. On this basis I expect they think there is no need. It is however possible to get dental pain from hot or cold drinks if your teeth are sensitive.

Because you will get a burn on something extremely hot, on something extremely cold, you will get a chill which cannot cause much damage and pain and it goes away quickly, a burn does not.
